Privacy Policy

This Privacy Policy ("Privacy Policy"/ "Policy") describes how and when Reliance BP Mobility Limited, a company incorporated and registered under the provisions of the Companies Act, 2013 having its registered office at [Maker Chambers IV, 3rd Floor, 222 Nariman Point, Mumbai – 400 021] (hereinafter referred to as “RBML”, “we”, “us” or “our”) which expression shall, unless repugnant to the context or meaning thereof, be deemed to include its successors, affiliates and assigns) collects, processes, uses, stores, shares, handles and protects your information.

The Policy also indicates how you can access and update your information and make certain choices about how your information is used.

The Policy is applicable to the Platform (as defined below) and governs RBML’s collection, processing, usage, storage, sharing, handling and protection of Personal Information and Sensitive Personal Data or Information as defined under the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 (“SPDI Rules”).

RBML endeavours to comply with all the applicable laws, the Information Technology Act, 2000 and the SPDI Rules, or any other specific laws which deal with the subject matter of this policy. To the extent that any provision of this Policy is in conflict with provisions of any applicable law, the same shall be inoperative and RBML will undertake reasonable efforts to expeditiously amend such provision on becoming aware of the same.

Platform” shall mean the freight-as-a-service platform which is developed and owned by the RBML and accessible through the following methods:

  2. The portal at https://faas-a.jiobp.com/portal/#/admin/signin (“Portal”)

By accessing/using the Platform, you (for yourself and on behalf of the organisation/entity as its authorised representative; collectively referred to as “you”) agree to the terms of this Policy and the Terms of Use (which have been provided at “Platform/Application”) and consent to the collection, transfer, processing, storage, disclosure and other uses of your Information as provided herein. If you do not agree with the terms of this Policy and/or Terms of Use, please do not access/use the Platform. You represent that you are a resident of India and are accessing/using the Platform from India. If you do not reside in India or are not accessing/using the Platform from India, you shall not access/use the Platform.

For the purposes of this Policy:

“Information/Personal Information” shall mean any information which relates to a natural person, which, either directly or indirectly, in combination with other Information available or likely to be available with a body corporate, is capable of identifying such person, and shall include any SPDI.

“SPDI” mean any Information/Personal Information of a person which consists of information which consists of Information relating to:

  1. password;
  2. financial Information such as Bank account or credit card or debit card or other payment instrument details;
  3. physical, physiological and mental health condition;
  4. sexual orientation;
  5. medical records and history;
  6. Biometric information;
  7. any detail relating to the above clauses as provided to a body corporate for providing service; and
  8. any of the Information received under above clauses by body corporate for processing, stored or processed under lawful contract or otherwise,

provided that any information that is freely available or accessible in public domain or furnished under the Right to Information Act, 2005 or any other law for the time being in force shall not be regarded as SPDI.

Supply Partner Agreement” shall mean the agreement executed between RBML and the Supply Partner (as defined under the said agreement) for provision of transportation of consignments by road by the Supply Partner to RBML;

Demand Partner Agreement” shall mean the agreement executed between RBML and the Demand Partner (as defined under the said agreement) for provision of transportation services from RBML to Demand Partner.

End Customer Agreement/MSME/LE” shall mean the agreement executed between RBML/RSIL and the End customer/MSME (as defined under the said agreement) for provision of transportation of consignments by road by the RBML or as the case may be

RBML Solutions India Limited / RSIL Is engaged into the business of providing transportation services, buying, selling, marketing, supplying, importing, exporting, trading, storing, distributing, transporting or otherwise dealing in all kinds of petroleum, petroleum products and by-products, petrochemicals including other related products and / or services, and provision of e-mobility / advanced mobility services (including battery swapping, freight aggregation and electric vehicle charging) and to act as dealer, selling agents, commission agents, sales organizers, distributors, stockists, del-credre agents, C & F agents, wholesalers and retailers for the aforesaid products, and to operate and maintain fuel storage and into plane distribution facilities and undertake sale and/or supply of aviation fuel at airports and designing, developing, erecting, installing, setting up, operating, maintaining, managing, owning, leasing, hiring retail or wholesale outlets, pumps, terminals, depots, convenience stores, showrooms, storage tanks, warehouses, godowns, objects, equipment, devices, facilities, infrastructure and to provide other related and /or ancillary services, facilities, assets or infrastructure, including but not limited to value added services of garage, service station, shop, office, parlours, hotel, motel, restaurant, guest house, rest house, facilities for communication, entertainment and other services and to plan, establish, develop, provide, promote, use, operate, conduct, procure, facilitate, maintain, do business, provide infrastructure and act as consultants and, agent for attaining the above object.

  1. Collection of Information

    1. Across the Platform, we collect the following Information:

      Website:

      • information you choose to upload, sync, send or import from the device on which the Website is being used or that you provide on chats, emails message boards or feedback forms on the Website.

      Portal:

      • your name, electronic mail address, phone number, password, IP address, and postal address in relation to the login credentials generated on the Portal;
      • information related to your usage of the services on the Portal, including order history, preferred orders etc.

      Demand Partner Application:

      • your name, electronic mail address, phone number password, IP address, and postal address in relation to the login credentials generated on the Demand Partner Application;
      • KYC details like address proof, GST registration information, PAN information, Aadhar information, etc. to establish your identity;
      • information related to your usage of the services on the Demand Partner Application, including order history, preferred orders etc.;
      • any and all information furnished, or required to be furnished under the Demand Partner Agreement;
      • technical data and related information, including but not limited to, technical information about your device, system and application software, and peripherals, that is gathered periodically to facilitate the provision of software updates, product support and other services to you (if any) related to such Demand Partner Application.

      Supply Partner Application:

      • your name, electronic mail address, phone number password, IP address, and postal address in relation to the login credentials generated on the Supply Partner Application;
      • KYC details like address proof, GST registration information, PAN information, Aadhar information, Vehicle Details etc. to establish your identity;
      • bank account related information;
      • any and all information furnished, or required to be furnished under the Supply Partner Agreement;
      • technical data and related information, including but not limited to, technical information about your device, system and application software, and peripherals, that is gathered periodically to facilitate the provision of software updates, product support and other services to you (if any) related to the Supply Partner Application.

      Driver Application:

      • your name, electronic mail address, phone number, password, IP address, and postal address in relation to the login credentials generated on the Driver Application;
      • KYC details like Driver License, Aadhar information, Vehicle Details etc. to establish your identity;
      • geographical location;
      • any and all information furnished, or required to be furnished under the Supply Partner Agreement;
      • technical data and related information, including but not limited to, technical information about your device, system and application software, and peripherals, that is gathered periodically to facilitate the provision of software updates, product support and other services to you (if any) related to such Driver Application.
    2. With respect to collection, usage, storage and processing of Information, please note we may also ask you to provide certain additional information about yourself on a case-to-case basis in relation to our Platform.

    3. RBML may collect Information relating to your activities while using/accessing the Platform from and about the devices through which the Platform are used/accessed, including SDK/API/JS code version, browser, internet service provider, timestamp, application identifier, application version, application distribution channel, independent device identifier, Android ad master identifier, network card (MAC) address, and international mobile device identification code (IMEI), the equipment model, the terminal manufacturer, the terminal device operating system version, the session start / stop time, location, language, the time zone and the network state (WiFi and so on).

    4. You agree to disclose your exact location by enabling your computer or mobile device to send us location information including without limitation, GPS coordinates, IP location, route and direction tracking, and speed of travel. RBML may use and store information about your location to provide the features of the Platform including geo-fencing/geo-tagging in connection with the usage of the Platform, and to improve and customize the services of the Platform. Collection and sharing of location data must be enabled to use the Platform.

    5. RBML may keep track of how you interact with links across the Platform, including third-party services, and client applications. RBML does this to help improve the Platform and the products and/or services available thereon.

    6. RBML’s servers automatically record Information ("Log Data") created by your use of the Platform. Log Data may include Information such as your IP address, browser type, operating system, the referring web page, pages visited, location, your mobile carrier, device and application IDs, search terms, and cookie Information. RBML receives Log Data when you interact with the Platform. RBML uses Log Data to provide services on the Platform and to measure, customize, and improve them.

    7. In case you make any payment over the Platform, you understand and acknowledge that RBML only facilitates the third-party payment gateway for processing of payment and all financial Information including bank account details in this regard is collected by such third-party payment gateway and not by RBML. RBML will not be liable for any acts or omissions on the part of the payment gateway. You should view the terms of service and the privacy policy of such third-party payment gateway prior to disclosing any sensitive personal data to such third-party payment gateway.

    8. When you use/access the Platform over the Supply Partner Application, Demand Partner Application, or the Driver Application (individually referred to as the “Mobile Application” and collectively referred to as the “Mobile Applications”), we may collect the following Information:

      • Your preferred language and country site (if applicable);
      • The manufacturer and model of your mobile device;
      • Your mobile operating system;
      • Your geolocation;
      • Information about how you interact with the Mobile Application and any of our web sites to which the Mobile Application links;
      • Data from SMS/ text messages upon receiving device permissions for the purposes of (i) issuing and receiving one-time passwords and other device verification, and (ii) automatically filling verification details during financial transactions, either through us or a third-party service provider, in accordance with applicable law. We do not share or transfer SMS/ text message data to any third party other than as provided under this Policy.
    9. If you email us, we may store copies of such email or similar communications between you and us. This can result in the collection of your email address or other personally identifiable information you may have in your email text, addresses, or other fields, as well as the collection of your IP address or other routing of your communication, and the date and time of your communication. All transmissions between you and us, including emails, URLs, cookie identification numbers, usage paths, and any Information they might contain, pass through many third-party machines, operating systems, programs, browsers, web servers, networks, routers, ethernet switches, ISPs, proxy servers, intranets, the public telephone systems, or other devices, any of which may create activity logs containing such transmissions, on which we have no control.

    10. All the calls made to and from our call centres are recorded and stored, along with all the chat histories. As provided under Clause 1.9 hereinabove, such calls and/or chats can result in collection of Information, and as explained hereinabove, such Information may pass-through third-party entities on which we have no control.

    11. We may, from time to time, supplement the information we collect about you through our website or Mobile Application or Platform with outside records from third parties in accordance with applicable law.

    12. It is clarified that any data which does not reveal your specific identity, or does not relate to an identified or identifiable individual or natural person, or information that is publicly available, or information about software and hardware usage, or any anonymised or aggregated data (“Other Information”) will not considered Information.

  2. Usage of Information

    1. The Information collected by RBML may be used:

      1. For the performance and in furtherance of the Demand Partner Agreement and the Supply Partner Agreement (as applicable);
      2. for your registration, login, usage and management of the Platform;
      3. to confirm your identity and associate your use of the Platform with any legal entity / person whom you represent, as applicable;
      4. to efficiently access your Information after you sign on the Platform;
      5. to understand your preferences and to enhance and customize your experience of using the Platform;
      6. for providing customized user relevant suggestion / services;
      7. to communicate with you through mail, e-mail and telephone, in connection with the Platform or any products or services provided or availed by you on the Platform;
      8. to respond to your comments, reviews and questions and provide better products, services and features with respect to the Platform;
      9. to tailor content, advertisements, offers and promotions offered on the Platform, and provide news and other information we think will be of interest to you;
      10. to perform market research, platform analytics and operations;
      11. to personalize and improve the Platform and products, services and advertising (including for third party products and services) made available on or outside the Platform (including on other sites/ apps that you visit), for example by providing personalized or localized content, recommendations, features, and provide advertisements, content or features that match your interests and preferences;
      12. to link or combine with Information we receive from others to help understand your needs and to provide you with better experience with the Platform;
      13. to respond to your questions and requests and provide customer service;
      14. for internal purposes such as auditing, data analysis, research and improvement relating to the Platform;
      15. for promotion and marketing purposes;
      16. for sharing such Information with any third party, including any service providers and affiliates or group companies of RBML, in the course of providing services through the Platform;
      17. to track and monitor your usage of any services procured or provided by you, on or via the Platform;
      18. to assess the quality of the services provided by or to you, on or via the Platform; and
      19. to transfer data to the regulatory authorities or other appropriate authorities as required by law.
    2. The information gathered from you shall be used for any reasons incidental to the reasons listed hereinabove.
    3. RBML does not transfer your Information to other countries outside of India. However, if any service provider we engage, as matter of backup or other general practices, transfers the Information between any of the countries in which service provider, over which we have no control on, you agree to such cross-border transfers of your Personal Information and the risk associated with it.
  3. Collection of Information by Third-Party Sites and Advertisers

    When you use the Platform, there may be certain links which may direct you to other websites or applications not operated/maintained by RBML (the “Third Party Site”). The manner in which your Information is collected, received, stored, processed, disclosed, transferred, dealt with and handled by such is governed by the terms and conditions and privacy policy of the respective Third Party Site(s). RBML hereby expressly disclaims all liabilities with respect to the way the third- party site collects and/or uses your Information.

  4. Cookies

    1. The Platform uses cookies (data files placed on a device when it is used to visit/access the Platform) and/or other similar technologies such as device-IDs, in-app codes, mobile analytics software, pixel tags or web beacons to collect and store certain information. These typically involve pieces of information or code that a website transfers to or accesses from your computer hard drive or mobile device to store and sometimes track information about you.
    2. The Platform uses cookies and similar technologies to:

      1. to distinguish you from other users of our Platform and to facilitate website navigation;
      2. to associate you with the legal person/entity whom you represent;
      3. to personalize your experience while using the Platform (such as allowing the Webiste, Portal and Mobile Applications to select which content, advertisements or offers are most likely to appeal to you, based on your interests, preferences, location, or demographic information), including personalizing the Platform for your use;
      4. for security purposes.
    3. Cookies and similar technology enable RBML to provide a good user experience for the Platform and also allows RBML to improve the Platform. Most web browsers automatically accept cookies and similar technologies, but if you prefer, you can change your browser settings to disable cookies. However, you may not be able to take full advantage of features available on the Platform if you do so, which you acknowledge that we will not be liable for.
  5. Disclosure to Third Parties

    1. RBML may need to disclose your Information, if required to do so by law and if such action is necessary: (a) to comply with a legal obligation; (b) to protect and defend the rights or property of RBML, including to enforce agreements, policies, and Terms of Use; (c) to protect the personal safety of the users of the Platform, or any person, in an emergency; (d) to protect RBML from incurring any legal liability; (e) to legal counsel representing RBML in judicial proceedings and/or accounting and auditing firms providing services to RBML; and (f) for reasons incidental to the above.
    2. RBML shall be at liberty to disclose your Information to: (i) any third party to facilitate the provision of products and services through the Platform; and (ii) any third parties who provide services, such as auditing, data analysis, platform improvement and assistance with delivery of content, relevant marketing messages and advertisements with respect to the Platform.
    3. If you provide a mobile phone number and/or e-mail address, RBML or the third-party service providers or the persons authorized by them, may send you text messages/e-mails/WhatsApp communication in relation to your use of the Platform.
    4. Your Information may also be used by RBML or shared with RBML’s sponsors, marketing partners, advertisers, advertising networks, advertising servers, and analytics companies or other third parties in connection with marketing, promotional, and other offers, as well as product information, and for such third party's advertising, analytics and market research.
    5. RBML may disclose or transfer your Information to any subsidiary or affiliate, for internal reasons, primarily for business and operational purposes. If another entity acquires RBML or all or substantially all of RBML's assets, or assets related to the Platform, your Information may be disclosed to such entity as part of the due diligence process and will be transferred to such entity as one of the transferred assets. If any bankruptcy or reorganization proceeding is brought by or against RBML, all such Information may be considered an asset of RBML and as such may be sold or transferred to third parties in accordance with applicable law.
    6. RBML may also share aggregated (and de-identified) information with third parties at its discretion.
    7. RBML contractually requires the third parties which whom Information is shared to keep such Information confidential and use it only for the purposes for which RBML discloses it to them.
  6. Security

    RBML uses reasonable security measures which are mandated under applicable law to safeguard and protect your data and Information. RBML has implemented such measures, as stated above, to protect against unauthorized access to, and unlawful interception of your Information. However, security risk cannot be completely eliminated while using the internet. RBML assumes no liability or responsibility for disclosure of your Information due to errors in transmission, unauthorized third-party access, or other causes beyond its control. You play an important role in keeping your Information secure. You should not share your username, password, or other security information for your account with anyone. You accept the inherent security implications of providing Information over the internet and agree not to hold RBML responsible for any breach of security or the disclosure of Information unless RBML has been grossly and wilfully negligent.

  7. Policy Towards Children

    The Platform is not intended for use by anyone younger than the age of 18 years. RBML does not knowingly collect Information from children younger than the age of 18 years without the consent of a parent or legal guardian; if RBML learns that it has done so, RBML will promptly remove the Information from all active databases. If you are a parent or legal guardian who believes that RBML has collected or used their child’s Information, please contact the Grievance Officer appointed by RBML available at the e-mail and contact number specified herein below.

  8. Legal Basis for Data Processing

    1. RBML processes Information for the purposes set out in this Policy, as described above. The legal basis to process Information includes processing that is:

      1. necessary for the performance of the contract with you (Supply Partner Agreement or Demand Partner Agreement, as the case may be);
      2. necessary to comply with legal requirements (for example, to comply with applicable accounting rules and to make mandatory disclosures to law enforcement);
      3. necessary for the legitimate interests of RBML (for example, to manage the relationship with you, to ensure the security of the Platform, to communicate with you about RBML’s products and services); and
      4. based on consent by users of the Platforms.
    2. In some instances, you may be required to provide RBML with Information for processing as described above, in order for RBML to be able to provide you and for you to use all the features of the Platform. In the event you choose not to provide any Information requested by RBML, notwithstanding anything, RBML reserves the right to cancel, suspend or cease performance of any service procured by you via the Platform.

  9. User Discretion

    1. Subject to limitations in applicable law, you are entitled to object to or request the restriction of processing of your Information, and to request access to, rectification, erasure and portability of your own Information.
    2. If you are a registered user of the Platform, the tools and account settings to access or modify the profile information you have provided and is associated with your user account will be provided to you.
    3. Where the use of your Information is based on consent, you can withdraw this consent at any time without affecting the lawfulness of processing based on consent before its withdrawal. Should you desire to withdraw your consent, RBML requests that you close your user account and stop accessing the Platform. If you are aware of changes or inaccuracies in your Information, you should inform RBML of such changes so that the records of RBML may be updated or corrected.
    4. RBML will retain your Information as long as needed to provide services through the Platform, or as required or permitted by applicable laws. Notwithstanding anything contained herein, Users as per their free will and volition upload their Data on this app, which will not be limited to KYC details and by uploading the requisite data as and when called for, users are well acquainted and give their assent that, the data once called for, submitted and uploaded on the application cannot be deleted and such act under whatsoever circumstances shall not attract provisions of IT ACT,2000 and Rules thereby and cannot be deemed in anyway as breach of privacy.

  11. Governing Law

    This Policy is governed by and operated in accordance with the laws of India and the courts of Mumbai shall have exclusive jurisdiction in respect of any disputes arising from this Privacy Policy.

  12. Amendments

    RBML retains an unconditional right to modify or amend this Policy without any requirement to notify you of the same, however, RBML will undertake commercially reasonable steps to generally notify any amendment to the Policy. You can determine when this Privacy Policy was last modified by referring to the “Version Dated” legend above. It shall be your responsibility to check this Privacy Policy periodically for changes. Your continued use of the Platform following the posting of changes to this Privacy Policy on the Platform, will constitute your consent and acceptance of those changes.
